Scuffs on the bottom right and top left and scratches on the back.

Also came packaged with no padding. Charger was sitting open on top of the bare phone screen.

I would do almost completely positive since the phone came pretty quick but I encountered a problem with the charger adapter that came with the phone, or rather the phone has trouble charging. I hope it's just that the charger doesn't fit and not a problem with a phone, but I'll keep on checking.

Edit: It was the charger, bought a new one and everything works completely fine!
