It has been restored to factory settings so has iOS 7 right now but will be able to upgrade easily.

I just bought one or I would have considered it. Do not update it. To some people it is more valuable on a lower ios version. Like you said they can update it easily, but you might sell it quicker Because it's still on IOS 7. Thanks anyway.
