We got this brand new phone at Walmart and opened the box just as we realized it was with the wrong carrier for us. Then we missed the return window so we couldn't bring it back.

So while we couldn't select "new" in the listing because it was no longer factory sealed, the phone had not been turned on before taking the required photos you see here, and it is in the original retail packaging.
