I do not know if this qualifies for a free upgrade to Windows 10. Upon further investigation I found this information from the WINDOWS IT CENTER:
Administrators that want to upgrade Surface devices that are running Windows 8.1 or Windows 10 have the option of deploying upgrades. By performing an upgrade deployment, Windows 10 can be applied to devices without removing users, apps, or configuration.

Unfortunately this information does not specify if this upgrade is free.
