It is a new phone however Sprint did activate it so it isn't technically new, however you will be getting a phone that may as well be new :P

Sorry guys, I had a long day at work yesterday and couldn't get the photo up til now.

And it is unused, box was opened. Sprint sent me a new one without a box since my last one was malfunctioning but I also got a Nexus so I haven't used the iPhone.

Alex, you have this under Verizon, but you said Sprint sent you a new one. Which is it?Please email [email protected] with a photo of device showing the iPhone's "About" screen displaying the IMEI number and other identifiers. You can find that screen by tapping Settings > General > About. Thank you in advance for your cooperation.

Alex, this was listed under Verizon iPhones, so I moved it for you. Based on an ESN check with Apple it's support coverage is already well underway, and telephone technical support for the device has even expired, suggesting the device has been activated. (I uploaded a screenshot above.) So I'm afraid this cannot be listed as New condition.

Apple's Limited 1-year warranty will expire on December 6, 2013 per Apple's ESN check.

This phone was originally purchased and activated December, 2012.
